Welcome to our hosting platform (“we,” “us,” “our,” or “the Company”). By using any of our services — including but not limited to VPS hosting, Dedicated hosting, game hosting, or web hosting — you (“the client,” “user,” or “customer”) agree to be bound by the following Terms of Service. Please read these terms carefully before ordering or using any of our products.
1. Acceptance of Terms
By purchasing, accessing, or using our services, you acknowledge that you have read, understood, and agree to comply with these Terms of Service.
If you do not agree to these terms, you may not use our services.
2. Eligibility
You must be at least 18 years old or have parental consent to use our services.
By using our platform, you confirm that all information provided during registration is accurate, current, and complete.
3. Acceptable Use Policy (AUP)
All customers must adhere to our Acceptable Use Policy. The following activities are strictly prohibited and will result in immediate suspension or termination of your service without refund:
- Launching or participating in DDoS attacks, network stress tests, or any form of malicious activity.
- Cryptocurrency mining (e.g., Bitcoin, Ethereum, Monero, etc.) unless explicitly authorized by us in writing.
- Hosting, distributing, or linking to malware, viruses, phishing sites, or illegal content.
- Hosting copyrighted or pirated materials, including cracked software, movies, or music.
- Using the service for spamming, mass mailing, or unauthorized advertising.
- Running brute-force tools, botnets, stressers, port scanners, or exploit kits.
- Engaging in fraudulent, deceptive, or harmful behavior of any kind.
- Hosting or using any type of VoIP (Voice over IP) service, including but not limited to TeamSpeak, Mumble, SIP servers, PBX systems, or other telephony-related applications.
Violation of any of the above will result in immediate suspension or termination of all related accounts, services, and data, with no right to refund.
4. Service Suspension & Termination
We reserve the right to suspend, restrict, or permanently terminate any service at any time and for any reason, including but not limited to:
- Violation of our Terms of Service or Acceptable Use Policy.
- Non-payment or chargeback attempts.
- Activities that endanger network stability, security, or performance.
- Abuse, threats, or harassment directed at our staff or other clients.
In such cases, no compensation, refund, or data recovery will be provided.
5. Refund Policy
We offer a 3-day money-back guarantee on new orders.
If you are unsatisfied with your service, you may request a full refund within three (3) days of purchase.
Refunds are not available under the following conditions:
- After the 3-day period has passed.
- If the service was terminated due to policy violations or abuse.
- For upgrades, addons, or renewals.
- For payments made via cryptocurrency or other non-refundable methods.
All approved refunds will be processed to the original payment method.
6. Chargebacks & Disputes
If you initiate a chargeback or payment dispute through your bank or payment provider, your account will be automatically and permanently banned from our system.
All associated services will be terminated immediately and without notice.
We strongly recommend contacting our support team before opening a dispute to resolve any billing issues quickly and efficiently.
7. Service Availability
While we strive to maintain 99.9% uptime, we do not guarantee uninterrupted service.
Scheduled maintenance, hardware failure, or unforeseen circumstances may cause downtime.
We are not responsible for any loss of revenue, data, or damages resulting from service interruptions.
8. Backups & Data Responsibility
Customers are solely responsible for maintaining their own backups.
We may perform internal backups, but we do not guarantee data recovery.
Data loss due to suspension, termination, or system failure remains the customer’s responsibility.
9. Resource Usage
You agree not to exceed or abuse your allocated resources (RAM, CPU, bandwidth, or storage).
We reserve the right to limit, throttle, or suspend any service that negatively affects performance or other customers.
10. Support
Technical support is available through our official channels (e.g., ticket system, Discord, or email).
We are not responsible for third-party software issues, misconfigurations, or unsupported modifications.
11. Privacy Policy
Your personal data is managed according to our Privacy Policy.
We will never sell or share your personal information with third parties except as required by law.
12. Liability Disclaimer
Our services are provided “as is” and “as available.”
We make no warranties, express or implied, regarding reliability, availability, or fitness for a specific purpose.
We are not liable for direct, indirect, incidental, or consequential damages, including data loss or business interruption.
13. Changes to the Terms
We reserve the right to modify or update these Terms of Service at any time, with or without prior notice.
Continued use of our services after such changes constitutes acceptance of the revised terms.
14. Governing Law
These Terms of Service shall be governed and interpreted in accordance with the laws of the Netherlands.
Any disputes shall be handled exclusively by the appropriate local court.
